Using last week’s tragic shooting in Oregon, Democratic front-runner Hillary Clinton is seizing on the tragedy to promote her gun-control policy, should she be elected.
Clinton’s gun-control proposal, announced at a campaign rally today in New Hampshire, calls for banning private gun sales without a background check and allowing gun violence victims to sue firearms manufactures.
The gun grabbing policies Clinton announced Monday build on past promises, including universal background checks, withholding guns from domestic abusers, and renewing the so-called assault weapons ban. What she failed to mention, was the fact that we already have some pretty strict background checks on the books that nobody is actually enforcing.
Current Gun Laws are not being enforced
During Obama’s term in office, firearm prosecutions have actually plummeted. During his first year in office, the FBI reported 71,000 instances of people lying on their background checks to buy guns. One would think that an administration who says it wants stricter gun control policies and expanded background checks would have an exceptional record of going after those who break current laws; not so with the Obama administration.
Of the 71,000 instances where people were caught lying on their firearm background checks, only 77 of them were actually prosecuted by the Department of Justice, Yet, Clinton and Obama would like you to believe that we need even stricter background checks. When less than 1% of the people who are caught committing a crime are ever prosecuted, what exactly will these expanded background checks really do?
Another area where the Obama administration has failed to act is in the prosecution of gangs who illegally traffic stolen firearms. Instead, they blame law-abiding gun owners and the NRA, while ignoring illegal straw man purchases made by gang members. The ATF defines straw man purchases as using another person to acquire a firearm specifically when the end user is prohibited from acquiring the firearm.
Straw purchases are seldom prosecuted by the Obama administration, despite the fact that we already have laws on the books which make it a federal offense to make false statements on Form 4473. Under President Obama, these prosecutions hit a decade low in 2014, down almost 50 percent from their peak under President George W. Bush in 2004.
According to Syracuse University, who looked at federal data on firearm prosecutions, the number of federal weapons prosecutions fell to about 4,500 under the Obama administration in 2014.

But the most troubling part of her announcement was her plan to allow people to sue firearms companies for any crimes committed with that company’s firearm. It is equivalent to allowing someone who was injured in a car accident to sue the manufacturer, instead of the person who was responsible for the accident.
Should this crazy policy be enacted, it’s nothing more than a direct assault on the second amendment. It will put the entire firearms industry in jeopardy of being litigated out of existence.
