On March 2021, California Democratic Sen. Dianne Feinstein introduced her latest gun ban legislation, the “Assault Weapons Ban of 2021.” We’ve been tracking her attempt to pass the legislation since 2013; this page is an ongoing attempt to track and update what firearms would be affected in the never-ending attempt to kill the second amendment by the Senator from California.

With every attempt to pass the legislation, more firearms are added to the bill, Her own description of the latest bill states that it would ban “the sale, manufacture, transfer and importation of 205 military-style assault weapons by name.” 

According to Feinstein: “Americans across the nation are asking Congress to reinstate the federal ban on military-style assault weapons and high-capacity magazines. If we’re going to put a stop to mass shootings and protect our children, we need to get these weapons of war off our streets.”

If your firearms is not listed above, please keep in mind that this ban goes much farther than what’s listed above.  According to language in the bill, even a .22lr rifle (that has a detachable magazine and a rail system) would be considered an illegal weapon.

Firearm Accessories included in the “Assault Weapons Ban”

  • Firearms that accept “a detachable ammunition magazine and [have] one or more military characteristics including a pistol grip, a forward grip, a barrel shroud, a threaded barrel or a folding or telescoping stock.
  • Magazines would be banned if they “hold more than 10 rounds of ammunition.”

Other provisions in the Bill:

  • Bans any assault weapon with the capacity to utilize a magazine that is not a fixed ammunition magazine and has one or more military characteristics including a pistol grip, a forward grip, a barrel shroud, a threaded barrel or a folding or telescoping stock. 
  • Requires a background check on any future sale, trade or gifting of an assault weapon covered by the bill.
  • Requires that grandfathered assault weapons are stored using a secure gun storage or safety device like a trigger lock.
  • Prohibits the transfer of high-capacity ammunition magazines.
  • Bans bump-fire stocks and other devices that allow semi-automatic weapons to fire at fully automatic rates.
  • Bans stocks that are “otherwise foldable or adjustable in a manner that operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability of a firearm.”
  • Bans assault pistols that weigh 50 or more ounces when unloaded, a policy included in the original 1994 ban.
  • Bans assault pistol stabilizing braces that transform assault pistols into assault rifles by allowing the shooter to shoulder the weapon and fire more accurately.
  • Bans Thordsen-type grips and stocks that are designed to evade a ban on assault weapons.

Feinstein released the following statement on the updated 2021 bill:

“It’s been 17 years since the original Assault Weapons Ban expired, and the plague of gun violence continues to grow in this country,” said Senator Feinstein. “To be clear, this bill saves lives. When it was in place from 1994-2004, gun massacres declined by 37 percent compared with the decade before. After the ban expired, the number of massacres rose by 183 percent. We’re now seeing a rise in domestic terrorism, and military-style assault weapons are increasingly becoming the guns of choice for these dangerous groups. I’m hopeful that with the new administration and Democratic control of the Senate, we can finally pass commonsense gun reforms to remove these deadly weapons from our communities.”

    How many people could actually find a copy of the bill of rights.
    If you do some research, there are numerous instances of portions of our constitution that are routinely being circumvented and ignored.

    Im a 38 yr old construction worker that lives in Idaho. I have many guns. I pay my taxes and live a trouble free life. And i can assure you, if somebody tries to take my 2nd amendment rights from me. I won’t be nice.

No issue is more divisive in this nation than Gun Control and to a large part, the legislation that is being passed is intended to be abusive to gun owners, provide a false sense of security to non-gun owners, but in reality only serves to increase the threat to our security. All Assault Weapons are already regulated under the NFA because a firearm cannot be an Assault Weapon unless it has full automatic capability (AR-15s and AK47s in general use do NOT). The term Assault Weapon is abused by politicians as a scare tactic – if it sounds scary, it is. The California approach to so-called Assault Weapons is to create a list, require registration, ban new ones and force owners to either surrender without compensation or sell out-of-state. For a Federal Ban, if transfer is outlawed, how in the world would the government come up with the funds required to comply with the 5th Amendment (no taking of property without just compensation)? The only things the previous Federal Assault Weapon Ban did was increase panic buying, create two versions of the original firearm (pre and post) and dramatically increase the probability of a home burglar getting their hands on a firearm (because new gun owners seldom have gun safes). By comparison, in an economy that is booming under President Trump, Sturm Ruger, Smith & Wesson and Colt are all reporting lower earnings while our oldest gun manufacturer, Remington, just declared bankruptcy after 202 year of business.
    To me the message is clear. More is gained by not threatening to take away 2st Amendment rights and instead, focus on trying to come up with things that make sense instead of feel-good legislation that only serves to divide and get self-serving politicians re-elected.

    the action needed now is to arrest the bill writers , them who vote for it , co sign the bill , and all who sign off on them , via executive order or any cop of any dept .

    arrest the office oath breakers (to give them standing before the ct.) and FORCE the supreme court to enforce the charges or screw up and give proper cause for revolt to remove said traders.
    this is NOT a a revolt with cops or the public in conflict but with off base representatives and the rest of us USA citizens .

    so the time has come to arrest gun grabbers for failure to uphold oath of office to defend the constitution. arrest them , charge them , strip there retirements from office , heavily fine them , and BAN from ever holding any office again.

    the above is reasonably justified for even proposing the bills that have bin written up all ready that they wish to pass. the reason so many county’s have adopted gun sanctuary status is evident the bills ARE clearly unconstitutional. and an attack on self defense freedom. Arresting them (anti constitutional proposers , voters , co signers , and who signs off on said laws ) is the safest way to deal with this threat right NOW.

    give them standing to have supreme court look into this and decide whether they get it wrong before it is necessary to break out cold tar and feathers to take back the country. any law that requires added action by a gun owning citizen or fee to stay complaint when not breaking a law is NOT acceptable. nor is a law that steals rights from future citizens.

    No law is automatically ‘Constitutional’

    The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The Constitution of the United States is the supreme law of the land, and any statue, to be valid, must be in agreement. It is impossible for both the Constitution and a law violating it to be valid; one must prevail. This is succinctly stated as follows:

    The general rule is that an unconstitutional statute, though having the form and name of law, is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of its enactment, and not merely from the date of the decision so branding it.

    An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.

    Since an unconstitutional law is void, the general principals follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it . . .

    A void act cannot be legally consistent with a valid one.

    An unconstitutional law cannot operate to supersede any existing valid law.

    Indeed, insofar as a statute runs counter to the fundamental law of the land, it is superseded thereby.

    No one is bound to obey an unconstitutional law and no courts are bound to enforce it.
