Wyoming’s Firearms Protection Act: Wyoming Proposes Jail time for Feds who Enforce Gun Laws

wyomingWyoming legislators are telling the Federal Government that their Unconstitutional Actions will not be tolerated in the State of Wyoming. In response to the coming Federal Gun Control Proposals, Wyoming Legislators are proposing the Wyoming Firearms Protection Act (HB0104)

The Legislation, sponsored by Rep. Kendell Kroeker, attempts to nullify all federal laws made after Jan. 1, 2013 and states that they will be unenforceable within the borders of Wyoming. If the bill passes, it will allow Wyoming Law Enforcement to criminally charge any federal agent who attempts to take away a Wyoming resident’s 2nd amendment rights.

The Proposed Legislation states:

No public servant as defined in W.S. 6-5-101, or dealer selling any firearm in this state shall enforce or attempt to enforce any act, law, statute, rule or regulation of the United States government relating to a personal firearm, firearm accessory or ammunition that is owned or manufactured commercially or privately in Wyoming and that remains exclusively within the borders of Wyoming.

It then goes on to say that any Federal Agent who attempts to go after a Wyoming Citizen’s 2nd Amendment right, will be guilty of a felony and, upon conviction, will be subject to imprisonment for at least one year. The proposal tells the federal government that Wyoming will not allow them to Ban or restrict ownership of a semiautomatic firearm, and they will not comply with any attempt to register any state residents under a federal firearm registry.

  1. Wyoming has the smallest population of all the states, except maybe for Alaska, so if you like friendly people and fewer people, you’ll love Wyoming. You’ll love the tax policies, as well. If all the states were like Wyoming, this would be one hell of a country.

  2. Hello Gun Owners
    With the anti gun talk going on I began doing some research and discovered that there are nine categories of people that are precluded from gun ownership. The category that is most alarming is the Lautenberg Amendment.
    (Please Google Lautenberg Gun Ban Racking Up Horror Stories.)
    I just recently discovered that this amendment even existed. Probability is there are thousands upon thousands of citizens in violation of this Federal Law and do not know it. We have been conditioned to believe Felons could not possess firearms. Not Misdemeanors. The Lautenberg Amendment has been in existence far too long. Enough is enough. Too many lives and careers have been ruined for a Misdemeanor Domestic Violence conviction. Women unable to protect them self. Careers ended for Law Enforcement and Military. Not to mention Sportsmen. If the courts had found the act was serious enough the person would have been convicted of a Felony.
    Contact your elected official to get this law repealed. This injustice could happen to anyone.

  3. This is not only a major waste of time, it is highly unconstitutional to jail Federal agents who are doing their job. Jailing Federal agents would be cause for Wyoming to be placed in a state of treason against Federal Authority which was written deeply into the heart of the constitution. There would be some very serious consequences to such action, consequences that would be very unpleasant.

    Jailing Federal authorities for doing their job is the biggest joke I think I’ve ever heard. Sounds like John C. Calhoun has been resurrected with these extremist pre-civil war secessionist Southern style statements. Most of all this fear-mongering is just that, fear-mongering. There is no evidence that the Feds are going to take away anyone’s firearms, including mine or my neighbors. Background checks and a ban on the manufacturing or sale of any future assault weapons is not an extreme thing. It is responsible. There are certain guns that belong in the hands of our military and our police, not regular civilians. We still are not allowed to purchase machine guns. I would suppose that if the gun lobby and big gun industries were to have gotten a bill passed through congress that would allow civilians to carry machine guns then you’d think that was your God given right also. I think that the Founding Father’s would roll in their graves if they knew how extreme this issue has become.

    I read an article in the Jackson Hole News & Guide written by the brother of our Governor. He said the same thing about the fact that if such an extreme law were passed the law would face serious constitutional problems. He knows because he is a very smart lawyer who has studied the constitution in depth and not just picked the parts he liked and ignored the parts he did not like.

    Wyoming is far greater than this. This state was known as the Equality State, a state that was led by some great women in history. It’s time that we lived up to our progressive name and led instead of reacting in fear like a mob, filled with ignorance and stupidity. We are smart, innovative, strong, independent and resourceful people who have the capacity to lead in all important aspects of life.

    I seriously think that the subconscious issue here has little to do with the gun issue. I think it is about fear of Washington D.C., fear of the President and a fear of change. There is no evidence that Washington is going to take away any of our guns. Unfortunately the GOP, a party that is not coming up with anything new or innovative (thus causing the party’s demise) can only spin and react to things to cause the more red states to go nuts and to simply obstruct. That’s the sign of a party that is dying, not a party that is robust and thriving. It’s a sign of desperation. Last time I checked Romney lost the election in the Fall and he lost decisively. It’s time to move on.
